NEOLOGY Files Petition with Patent Trial and Appeal Board (PTAB) against Star Systems

/EIN News/ -- SAN DIEGO, Dec. 03, 2018 (GLOBE NEWSWIRE) -- On Monday, December 3, 2018, Neology, Inc., a leading provider of integrated end-to-end solutions for the tolling, electronic vehicle registration (EVR) and public safety markets, filed a petition with the Patent Trial and Appeal Board (PTAB) seeking Inter Partes Review of U.S. patent No. 9,842,233, entitled "Switchable Radio-Frequency Identification Tag," which issued to December 12, 2017, to Bruce Roesner and which is assigned to Star Systems International. Neology was forced to seek review of the patent because it covers a passive switchable tag product that was actually pioneered by Neology. In fact, Neology has 32 patents issued around the world and 16 pending applications, which all predate this Star patent. Neology is a leading innovator for products in the tolling space and the switch tag product that Neology has developed and championed to the tolling community is another example of Neology's innovation leadership. Neology encourages competition and understands that multiple suppliers is good for the industry. To this end, Neology is happy to partner with others in the industry to encourage innovation and ensure product availability. But Neology will not allow the its intellectual property to simply be usurped, especially by manufacturers operating in foreign jurisdictions.

Unfortunately, Neology has been subject to constant attempts to unjustly take advantage of its innovation and intellectual property. Neology has recently had to pursue district court litigation to stop infringement of its patents, an ITC action to attempt to stop the importation of infringing, low cost products from China, has had to enforce injunctions issued for trade secret theft of information related to its industry leading multiprotocol readers, has had to defend attacks on its patents at the very same PTAB, and now is forced to seek review of this Star patent that clearly attempts to claim what Neology and others have already done. A fact, Neology believes that Star and Roesner were well aware of. Hopefully, this latest action will make clear that Neology will defend its intellectual property and that the best way to take advantage of Neology's innovation leadership is to partner with Neology in an appropriate and legal manner.
