Sky International AG, a subsidiary of Sky plc, has won a Europe-wide trademark infringement against the Swiss company, SKW SKYWORTH Europe S.A.
An EU Trade Mark Court granted Sky a preliminary injunction prohibiting the offering, advertising and promotion of SKYWORTH branded televisions by the Defendant across the entire EU.
Acknowledging the reputation and distinctiveness of the Sky brand in Europe, it was found the use of the SKYWORTH brand for televisions is likely to cause consumer confusion and damage to the Sky brand.
Brett Shelton, Acting Head of International Intellectual Property, Sky International AG Comments: “Sky takes enforcement of its intellectual property rights extremely seriously and this is another positive step in protecting Sky’s brand. We are pleased with this positive and wide reaching decision.”
Sky is confident that the recent provisional decision will be confirmed after the main action hearing in February 2018.
